Diagonal cumulation based on permeability

In certain configurations where the old PEM rules continue to apply in some bilateral relations, limited cumulation possibilities exist through the application of the principle of permeability, which allows materials considered originating under the old rules to be treated as equivalent for the purposes of cumulation under the revised rules, subject to the applicable conditions.
Diagonal cumulation based on permeability is possible where two Contracting Parties apply the 2012 rules in their bilateral trade, while both apply the 2023 rules with the Contracting Party of final destination of the products.
